On March 14, 2022, the Monterey County Committee on School District Organization (“County Committee”) held a public hearing at the District Office in order to consider Pacific Grove Unified School District’s transition to by-trustee areas. The County Committee approved Resolution 21-22-33, approving Pacific Grove Unified School District’s transition to by-trustee area elections, the sequencing of elections as requested by the School District, and the Teal map. The County Committee’s resolution is available here.
As a result of these actions, future Board elections commencing in November 2022 will be held by trustee-area, with the seats in trustee areas 1, 3, and 5 up for election at that time.

At its Board meeting of March 3, 2022, the Pacific Grove Unified School District held a public hearing to adopt a trustee area map and sequence of elections. The Board adopted Resolution No. 1085, approving the Teal map, and determining that the trustee areas 1, 3 and 5 would be up for election in 2022, while trustee areas 2 and 4 would be up for election in 2024. On February 10, 2022, the Pacific Grove Unified School District Board of Education held a public hearing regarding the content of the draft trustee area maps and proposed sequence of staggering the elections of trustees, pursuant to Elections Code section 10010, subdivision (a)(2). The Board heard from the public as to their thoughts and questions about the draft maps. The Board identified the Teal and Lupine maps as its tentative choices to consider moving forward.

The Board will hold a final map adoption hearing on March 3, 2022, to gather input form the community on the Teal and Lupine maps before selecting a map and sequence of elections to submit to the County Committee for consideration.
NOTICE OF PUBLIC HEARING
Public Hearing Before the Governing Board of the Pacific Grove Unified School District Pursuant to Elections Code section 10010, Subdivision (a)
The Pacific Grove Unified School District (“District”) Board of Education is currently elected using an “at-large” election system, where Board members are elected by voters of the entire District. Trustees are elected in even-numbered years and serve staggered, four-year terms, such that the next election for three (3) trustees is scheduled for November 2022, with the remaining trustee seats scheduled for election in November 2024. On April 22, 2021, the District Board adopted Resolution No. 1069, declaring its intent to transition to by-trustee area elections, where each Board member must reside within a designated trustee area boundary, and is elected only by the voters in that trustee area.
On August 19 and September 16, 2021, the District Board held two public hearings to receive input from the community on the trustee-area map creation process, pursuant to Elections Code section 10010, subdivision (a)(1). On November 2, 2021, the District Board held an additional town hall meeting to allow members of the community to provide input and dialogue regarding what the Board should consider in creating trustee area boundary maps. On January 20 and February 10, 2022, the District Board held two public hearings to receive community input on the draft trustee area boundary maps, pursuant to Elections Code section 10010, subdivision (a)(2), which are available above. After reviewing each of the seven maps, the Board eliminated the Green, Orange, Silver, Monarch, and Cypress Maps from consideration.
Notice is hereby given that the District Board will conduct another public hearing to receive community input on the two maps still in consideration (Teal and Lupine). Following the public hearing, the Board will vote to select a preferred trustee area map and election sequencing, to be submitted to the Monterey County Committee on School District Organization for consideration. The public hearing will occur as follows:

The following maps impact the areas from which voters will elect Board members, starting in November of 2022. The Board encourages members of the public to comment on these proposed maps (either at our next public hearing, or by emailing CVRA@pgusd.org) to help determine the trustee areas that will be used in future elections. Feel free to share any thoughts or comments on the maps for the demographer to consider when finalizing the boundary lines (e.g., which map you prefer, where particular lines should be drawn, what communities of interest should be kept intact, etc.). At the November 2 Town Hall Meeting, the Pacific Grove Unified School District Board received input from members of the community on the trustee area map development process. In order to facilitate continued communication between the public and the District’s demographer, we have developed the CVRA@pgusd.org email account for members of the Pacific Grove community to send additional input and suggestions as to what the demographer should consider when drafting boundary lines. The account will be monitored regularly, and the feedback will be considered as the demographer creates draft trustee area maps, which will be made available for the public to review in January of 2022.

Background on the CVRA
The California Voting Rights Act, or CVRA, prohibits the use of election systems that impair the ability of a protected class to elect candidates of its choice or its ability to influence the outcome of an election. There is only one method of electing trustees that jurisdictions can use that protects the public agency from challenge under the CVRA: by-trustee area elections. In a by-trustee area election, each trustee must reside within the designated trustee area boundary, and is elected only by the voters residing in that particular trustee area.

The Pacific Grove Unified School District Board of Education is working with National Demographics Corporation, demographic experts who presented information on the process and potential criteria for drawing the trustee-area boundary maps. After the demographer’s presentation, the Board held the second of two statutorily required hearings and received input from the community on the trustee-area map creation process, pursuant to Elections Code section 10010, subdivision (a)(1).
At this meeting, the Board considered an optional resolution to identify specific criteria to guide the demographer in the development of draft trustee area maps. The criteria options were identified in a checklist format as Exhibit A to the resolution, allowing the Board choice in which criteria to prioritize. After discussion, the Board decided not to take action on the resolution on September 16, as it wanted additional time to gather further community input to determine what factors the public would prefer trustee area maps take into account. Again, a resolution laying out the criteria is not legally required.

The Board adopted Resolution 1069, declaring its intent to transition from at-large to by-trustee area Board elections, where each Board member must reside within the designated trustee area boundary, and is elected only by the voters in that trustee area.
